**Job Summary** Location: Queens, NY
Act as the General Contractor’s representative to the Owner to execute all aspects of the Owner’s Diversity Compliance Program for Equal Opportunity for the project \(the “Diversity Program”\)\. The Diversity Compliance Officer \(“DCO”\) will be responsible for managing, tracking, auditing and verifying compliance with the Owner’s Diversity Program including the subcontractor participation, performance and reporting to insure that all good faith efforts are being made to meet the Diversity Program goals\.
Specific Duties:
A\.Developing a Participation Plan:
99. Conduct outreach to disadvantaged contractors and subcontractors \(the “Disadvantaged Firms”\) by participating in workshops, seminars, vendor fairs and other activities designed to solicit the participation of such disadvantaged contractors and subcontractors\. Fully document good faith efforts to solicit qualified disadvantaged contractors and subcontractors sufficient to meet the project’s overall Diversity Program goals\.
99. Conduct accurate and thorough vetting of the Disadvantaged Firms \(including both “1sttier” disadvantaged contractors and subcontractors, as well as those Disadvantaged Firms engaged as subcontractors by the trade contractors \(i\.e\., those disadvantaged subcontractors that are “2ndtier” to the General Contractor\)beforethose Disadvantaged Firms are placed on the project’s Participation Plan\. Such vetting efforts shall include:
99. Coordination with the General Contractor’s diversity officer and resources in New York where required;
99. Confirmation through a database check that the certifications for all Disadvantaged Firms appearing on the project Participation Plan are up to date and from the appropriate certifying agencies; and
99. Engage and/or assist in the General Contractors rigorous vetting process for Disadvantaged Firms, including initial “field audits” to reasonably establish that the Disadvantaged Firms are capable of performing a commercially useful function\. These initial field audits – to be conductedbeforea Disadvantaged Firm is placed on the Participation Plan for the Project – will include a visit to the Disadvantaged Firm’s office and/or warehouse and an interview of the firm’s majority owner\.
99. Compile contract award bid and related documents for submittal
B\. Ongoing Monitoring of the Participation Plan, Its Participants, and the Overall Project Utilization Goals:
99. Conduct reasonable “field audits” at the project site once work has commenced to confirm that the Disadvantaged Firms on the Participation Plan are actually performing a commercially useful function in the field\. Such audits will include site visits, interaction with the project supers and interaction and interviews of the Disadvantaged Firm’s foremen and/or laborers to confirm that the work is actually being performed by and under the supervision of the Disadvantaged Firm\.
99. If attainment towards the overall Participation Plan goal is reduced, troubleshoot how best to replace the lost attainment by additional firms or additional scopes of work and document the good faith efforts made to meet the goals of the Diversity Program\.
99. Preparing and Analyzing Data to Produce Monthly Reports Called for Under the Project’s Diversity Program:
99. Collect relevant data relating to Disadvantaged Firm contractors and subcontractors, including hours worked and ethnicity and gender of workers; analyze the data; and generate a Monthly Employment Utilization Report \(MEUR\) to be submitted to the Owner\.
99. Collect and log all monthly compliance reports and confirm that the data is complete\. Match the report to the prior submission to ascertain the utilization of M/WBE’s and the status of their progress payments\.
99. Prepare the Executive Summary of the MEUR which details the overall hours worked by subcontractor in a given trade\.
99. Research and reconcile issues when a subcontractor is not responsive and fails to submit the requested documentation such as a Certified Payroll Report or Utilization Report\.
99. Attend weekly Project meeting\(s\) to stay abreast of current Project issues\.
99. Receive, log, copy, and transmit compliance reports denoting progress payments to M/WBEs\.
**Minimum Requirements** Prior experience with diversity program reporting, certifications and classifications\.
The ability to make frequent trips to active, onsite construction sites and contractor/subcontractor firms to monitor participation and validate reporting statistics and contract requirements\.
Strong Excel skills\.
**Preferred Qualifications** College degree is preferred\.
Familiarity with construction/ contracting typically gained from a minimum of 5 years of related construction support functions\.
Investigative experience a plus
